Meet First Recipient of the H. Lee Sarokin Gavel Award, Presented by A Just Cause ...

"If a scam, would you single out Law Enforcement agencies, as your sole Customers?"

Judge H. Lee Sarokin served on the United States District Court (New Jersey), appointed by President Carter, and the United States Court of Appeals (3rd Cir.) appointed by President Clinton. He retired in 1996 after 17 years on the federal bench and now resides in Rancho Santa Fe, California.

 

In 1985, Sarokin famously overturned the 1967 triple murder conviction of former middleweight boxer Rubin Carter resulting in Carter's release. Sarokin ruled that Carter had not received a fair trial as the prosecution had been based on 'racism rather than reason' and 'concealment rather than disclosure'.

 

Judge Sarokin has taken an interest in the IRP6 wrongful convictions case and posted a five-part series in the Huffington Post, in which he is an ongoing contributor:

Judge Sarokin says, Court of Appeal had enough evidence to conclude that IRP6's rights were indeed violated and the court should either reverse or remand for a new trial or dismiss.

Judge H. Lee Sarokin volunteered 2.5 years of his time and service to thoroughly investigate the wrongful convictions of the IRP6. After his findings of 'No Criminal Intent' was demonstrated by the IRP6, he continued to advocate for their freedom and release from federal prison.

In honor of his ongoing efforts, the H. Lee Sarokin Gavel of Honor Award was created by a non-profit advocacy organization, called A Just Cause. This award recognized individuals, who possess the qualities of the good Samaritan, crying out against injustice and abuse wherever found, and making extraordinary personal sacrifices to advance the cause of justice for their fellow man and humanity, as a whole.

 

Appropriately, the first H. Lee Sarokin Gavel of Honor Award recipient was presented to its namesake, the Honorable H. Lee Sarokin, federal judge, good Samaritan, and fierce protector of every human's constitutional rights.

Sadly, Judge Sarokin, passed away at the age of 94 on June 20, 2023. The IRP5 sincerely expresses our deepest sympathies, best wishes, and prayers to his wife Marjorie, children, extended family, friends, and other loved ones. Though he will be greatly missed, he will always be remembered as a "HERO" to the IRP5!

The judge who freed famed boxer Rubin “Hurricane” Carter from prison after 19 years, saying his prosecution was based on “an appeal to racism rather than reason,” has taken on another long-shot case with racial overtones: the conviction of six Denver men, five of them black, who launched a software company to help federal, state and local law enforcement agencies communicate with each other after the failures preceding the Sept. 11, 2001, terrorist attacks.

A Just Cause Questions Why Judge Christine Arguello and Assistant U.S. Attorney Matthew Kirsch Fought So Intensely to Keep Intent ouf of the IRP6 Case 

 

A Just Cause Contends That Clarifying Intent in Jury Instructions and Allowing Evidence About IRP6 Business and Software Product Would Have Resulted in a Not Guilty Verdict and Dismissal of the Case

DENVER, CO--(October 23, 2015) - A Just Cause (AJC) remains baffled by the injustices and inequities that occurred in the IRP6 case, particularly the fierce opposition of the court and the government on the issue of intent. The IRP6 argued to allow the jurors to consider intent -- to no avail. "We firmly believe that the decision in this case would have been vastly different had all of the IRP6 evidence, with respect to their business prospects, software product, and expert witnesses had been permitted. Judge Christine Arguello excluded so much of the evidence that she single-handedly debilitated the IRP6 defense and left them facing what turned out to be insurmountable odds in the eyes of the jury," states Lamont Banks, Executive Director of A Just Cause.

 

The IRP6 are six executives that worked at IRP Solutions Corporation, which was raided by the FBI in February 2005. After the raid, false charges of mail and wire fraud were brought against the six executives -- David A. Banks, Kendrick Barnes, Demetrius K. Harper, Clinton A. Stewart, Gary L. Walker, and David A. Zirpolo -- who were all tried and wrongly convicted in 2011 for failure to pay debts to staffing companies related to completing software development work for sales to law enforcement agencies, specifically the Department of Homeland Security and the New York City Police Department (D. Ct. No. 1:09-CR-00266-CMA).
