Pursuit of Happiness

Our Declaration of Independence held it self-evident, that all are created equal and are endowed by God with certain inalienable rights, among which are "Life, liberty and the pursuit of happiness". The Supreme Court of the United States (SCOTUS) in Meyers v. Nebraska, 262 U.S. 390, 399, 67 L. Ed. 1042, 43 S. Ct. 625 (1923) stated: "Without doubt, [liberty] denotes not merely freedom from bodily restraint but also the right of the individual to contract, to engage in any common occupations of life, to acquire useful knowledge, to marry, establish a home and bring up children, to worship God according to the dictates of his own conscience, and generally to enjoy those privileges long recognized at common law as essential to the orderly pursuit of happiness by free men." People have migrated to this country to gain the freedom necessary to pursue their dreams. America is not what it used to be.

From the moment we are born we begin to pursue our interests and our happiness. The pursuit of happiness is something that is innate in every person that God has given life. To pursue happiness is unconscious --- it is automatic --- it is woven into the very fabric of who we are. When a baby is born he immediately begins to explore the world around him and pursue things that interest him and make him happy. To have life is to pursue happiness. Freedom invigorates our pursuit of happiness and ignites zeal to pursue dreams and accomplish goals. God gave us these rights and they are invaluable --- they are precious and we cannot sit idly by and let oppressive prosecutors and judges rob us of these gifts that God furnished. We must fight. The Walsh regime that consists of U.S. Attorney John Walsh, Assistant United States Attorney's Matthew Kirsch and Suneeta Hazra, Judge Christine M. Arguello and Court Reporter Darlene Martinez robbed me, Gary Walker, Demetrius Harper, Clinton Stewart, David Zirpolo and Ken Barnes of our freedom through a violent and malicious misuse of the law. They are oppressors. They are tyrants. Oppressors and tyrants don't care about fairness, equity, or individual rights to pursue happiness.

An oppressor is defined as one who exercises their power or authority in an unjust or cruel manner. A tyrant is defined one who uses authority or power brutally or harshly. It is brutal and cruel to wrongfully imprison innocent men. Kim Jong Un has wrongfully imprisoned Kenneth Bae. The U.S. government rightfully labels Kim Jong Un as a tyrant and has asked for the release of Mr. Bae to no avail. Kim Jong Un doesn't pursue justice, he pursues oppression. The IRP6 have been wrongfully imprisoned by the Walsh regime. Are they not tyrants? They also pursue oppression. I am certain they would speciously argue that we were afforded due process of law. The problem is that our due process was oppressed by a group of judicial tyrants. Whether a tyrant unilaterally imprisons someone wrongly or a group of judicial officials conspire to wrongfully imprison through malicious misuse of the law, it is still tyranny. North Korea does not have our Constitution nor our Declaration of Independence. The truth is that the U.S. justice is no better than North Korean justice. The only difference is that U.S. justice is self-righteously cloaked in constitutional rhetoric.

Kim Jong Un is immune and will not be made to answer to anyone. Likewise, U.S. justice officials are cloaked with immunity and will not be prosecuted for the laws they have broken and are not answerable. To date, President Obama and Attorney General Eric Holder, who is aware of the conduct of these officials, hasn't pursued justice. I guess they're too busy pursuing the happiness associated with their political careers to be concerned about the constitutional rights of the people they took an oath to serve. The 10th Circuit Court of Appeals hasn't executed justice and given the circumstances of the 200 missing pages of a transcript, it appears that pursuing justice is not a source of happiness for them. My mother always said that when someone slow to act they really don't want to do it. So from prison we fight for our freedom to regain the unfettered pursuit of our happiness which has been stolen from us by these judicial tyrants. I find myself shaking my head in utter sadness and disappointment that we have to fight for our justice because irresponsible prosecutors and judges have failed to do so. Thank God that I have a sense of justice.

I am pursuing justice, I am pursuing the truth. I must pursue change in our justice system. Every day, equity and justice grows inside of me. I think to myself this cannot happen to another person. I must make a difference. Oh my God! Help me to help someone else that is hurting from injustice! Help me to convey to our justice officials and legislators that we must make changes. Men, women and children are hurting! Children cry, families are destroyed and parent's hearts are breaking! No one really seems to understand the pain of being wrongly imprisoned! We can't pursue our dreams, we can't be with the people we love, we can't provide for our families, we can't attend the church, we can't open our refrigerator, we can't drive our cars, we don't even have the freedom to eat food of our choosing, we can't get some much needed peace and quiet. We didn't commit a crime! We didn't do anything wrong! We are the wrongly convicted. We are the IRP6. We love God and our families, spending time with our wives and children and attending church. We love our business. We love technology. I love to travel, learn about different cultures, people and food. Gary love's to hike, golf with his son Kyle and walking his dog named Socks. Demetrius loves providing for his family, scuba diving, preaching and mentoring kids in sports and vacationing with his family. David Zirpolo loves electronic gadgets, Internet research, and loves and misses the children of the Sunday school he oversees, Clint loves spending quality time with his only daughter Tiffany and doing technology research. Ken loves walking his dog Stevie, fishing and golf. Last but certainly not least, I love my mother, who is also a pastor and friend to Gary, Demetrius, Ken, Clint and David Z. We have been unjustifiably deprived of our pursuit of happiness by these despicable judicial officials. We and our families are victims of prosecutorial and judicial tyranny.

The Walsh regime's conduct in concealing 200 pages of our court transcript shows a deliberate indifference to our right to be free from unjustified imprisonment. SCOTUS acknowledged that intentional conduct by government officials who exhibit a "deliberate indifference is egregious enough" to shock the conscience and violate the Due Process Clause of the Constitution. See County of Sacramento v. Lewis 523 U.S. 833 (1998). We have a right to judicial relief from the 10th Circuit Court of Appeals but none has been granted. The 10th Circuit case of Garcia v. Miera, 817 F.2d 650 (10th Cir. 1987) in referencing the SCOTUS case of Meyers v. Nebraska mentioned above, recognized that our constitutionally protected "right to be free from, and to obtain judicial relief for, unjustified intrusions on personal security," including "bodily restraint and punishment", is essential to the pursuit of happiness.

Our God-given inalienable rights of life, liberty and pursuit of our happiness have been brutally taken from us without a cause from those who swore to protect those rights. Life is liberty. Liberty empowers the pursuit of happiness. Justice and truth has fallen in the street. Who will pick them up? We couldn't and wouldn't surrender our precious rights and our dignity by accepting a plea bargain for a crime we never committed. We had to fight for our rights. They are priceless and we will never stop fighting and pursuing until we lay hold on them again.
