It is a well-known fact that trials in the United States are public. The Sixth Amendment of the Constitution directs that "in all criminal prosecutions, the accused shall enjoy the right to a speedy trial and public trial..." The Supreme Court of the United States case: In re: Oliver, 333 U.S. 257, discusses the importance of public trials, stating that. "...the guarantee to an accused that his trial be conducted in public...has always been recognized as a safeguard against any attempt to employ our courts as instruments of persecution. The knowledge that every criminal trial is subject to contemporaneous review in the forum of public opinion is an effective restraint on possible abuse of judicial power". The court also stated that secret trials symbolize "a menace to liberty", just like the secret trials of the Spanish Inquisition, English Court of Star Chamber and the French monarchy's abuse of the letter de cachet. Finally, The Supreme Court quoted 18th century jurist Jeremy Bentham: "Without publicity, all other checks are insufficient...Recordation, appeal...would be found to operate rather as cloaks than checks; as cloaks in reality, as checks only in appearance". A wall of secrecy has been erected by Judge Arguello, court reporter Darlene Martinez and the U.S. Attorney's Office in Colorado to conceal 200 pages of court transcripts from the IRP6 and the public. Transcripts in which the IRP6 have alleged that Judge Arguello abused her judicial power when she violated their 5th Amendment rights by forcing us to testify under threat in our trial. Court officials conspiring together to persecute and imprison innocent men and concealing judicial abuse is an abomination. Americans must be made aware of the gross abuse and constitutional perversion that routinely occurs behind the walls of U.S. courts. "And he brought me to the door of the court; and when I looked, behold a hole in the wall. Then said he unto me, Son of Man, dig into the wall; and when I had digged in the wall, behold a door. And he said unto me, Go in, and behold the wicked abominations that they do here." Ezekiel 8:7-9 I am sick and tired of hearing many police, prosecutors, judges and politicians pay lip service to justice when their actions don't measure up to the cause of justice. Clichés like "Bring them to justice", "Do justice", "Justice was served" are played out. What is justice and how can it be measured? You routinely hear the Department of Justice (DOJ) tout a 99% conviction rate. You hear police across the country talk about how many arrests they made and how many people they locked up. I once read where a judge said his goal was to give out 1 million years of prison time by the time he retires. Should we consider it a badge of honor that the United States houses 25% of the world's prison population? Justice is not something that can be quantified by the number of convictions or years of prison time --- it is qualitative. When you look up justice in the Merriam Webster Dictionary, it is defined as fairness, righteousness, the administration of what is just. The definition of righteous is morally right or justifiable, arising from an outraged sense of justice or morality. Justice is not just a job, it is a calling. Calling is defined as a strong inner impulse toward a particular course of action. Our police, prosecutors and judges must internally possess a strong inner impulse toward doing what is just or right --- an outraged sense of justice or morality in every action, every decision, and every exercise of discretion. Justice doesn't just happen, it must be pursued. Martin Luther King Jr. pursued racial equality --- he pursued fairness and equity --- he pursued justice. What would MLK have accomplished if he measured his success by how many KKK members or rogue police officers he killed? He would have been considered a criminal guilty of murder. Are rogue prosecutors and judges any less than a criminal when they intentionally break the law and destroy lives of innocent Americans? The only difference is that Congress has not enacted any laws to hold them accountable and punish them for their willful criminal conduct. I have seen and experienced U.S. justice up close and personal. I am behind the wall. I went through the door. What I found are wicked abominations contrary to the cause of justice being repeatedly perpetrated by government officials from the FBI, U.S. Attorney's Office and federal judges. They got a conviction and doled out some prison time but justice was not served. The actions of the prosecutor and judge to gain the conviction were unethical, immoral, abominable and manifestly unjust. The vast majority of Americans are ignorant to the realities of the U.S. justice system. The mainstream media's portrayal that prosecutors and judges are pursuing truth and justice is a fallacy. While there are some good prosecutors and judges that are concerned with justice, I believe it is the exception and not the rule. Let me be blunt about conclusions that can be drawn related to conduct of government officials from court records in the IRP6 case. All circumstances point to judicial officials not pursuing justice. In fact, the evidence indicates they willfully and intentionally pursued injustice by pursuing convictions and imprisonment of innocent men. Take a look at what really happens behind the wall and through the door of the U.S. justice system. 1) Judge Arguello threatened to rest our case if one of us (the defendants) did not take the stand in our pro se trial. 2) Judge Arguello then lies about her statements compelling our testimony. 3) Judge Arguello and the stenographer Darlene Martinez conspired to obstruct justice by disposing/concealing court records. 4) Federal prosecutors Matthew Kirsch and Suneeta Hazra witnessed Judge Arguello forcing defendant's testimony yet failed to report exactly what they heard. 5) Kirsch and Hazra joined the conspiracy of Arguello and Martinez by opposing release of the court records to resolve the dispute of what Judge Arguello told the IRP6 related to them testifying. 6) Judge Arguello did not allow IRP6 witnesses Andrew Albarelle and Kelli Baucom of Remy Staffing to testify for the defense thereby not allowing the IRP6 to present their defense. Judge Arguello stated that the government had not been properly notified about Albarelle, even though both Albarelle and Baucom was on our witness list provided to the government and Albarelle had sent letters to the U.S. Attorney John Walsh with their qualifications and evaluation of the facts of our case. Judge Arguello made the excuse that Walsh may have not passed the letters to Kirsch. What makes Arguello's reasoning more ridiculous was when she requested the letters in open court, Kirsch immediately provided them to her from his own files. 7) Judge Arguello, in open court, and with prosecutors present, questioned the IRP6 about what witnesses were going to testify and what would be the content of their testimony. We objected to the prosecutor’s presence. We watched as prosecutors took notes about our upcoming witnesses’ testimony. 8) The 10th Circuit Court of Appeals denied to do anything about the 200 pages missing from the transcript --- stating the IRP6's complaint about the 200 missing pages was frivolous 9) Government illegally gained access to our church's banking records and some of the parishioners, likely using the Patriot Act to gain access. Both Arguello and Kirsch denied us viewing the alleged grand jury subpoena's they say were used to gain access to the banking records. Sounds just like the conspiracy to cover up the transcript doesn't it? This time it indicates Judge Arguello and Kirsch. 10) Judge Arguello imprisoned my sister Lawanna Clark for perjury even though evidence presented after trial proved perjury never happened. Judge Arguello justified sending Lawanna to prison by stating she should have brought the evidence forward during trial. In light of these facts and circumstances, no one can rationally conclude that these officials pursue justice or truth. Their reprehensible actions and conduct can be considered nothing less than unethical, illegal, criminal, immoral and outright cruel. What it shows is that you can't judge a person by their title. Judge, prosecutor, federal agent are endearing terms that are supposed to represent the high calling of justice, but who are the people behind the titles and do they possess the qualities of honesty and integrity --- do they have a strong inner impulse towards equity, fairness, and justice. Martin Luther King Jr. said that we should judge men by the content of their character --- not by the color of their skin --- certainly not by their job title. Martin Luther King Jr. not only talked about racial equality, he actively pursued racial equality. Judge Arguello, AUSA's Matthew Kirsch and Suneeta Hazra, U.S. Attorney John Walsh and some judges in the 10th Circuit talk about justice, took an oath to do justice and uphold the Constitution, but have not pursued justice in the IRP6 case and likely in many other cases. They have not walked worthy of the vocation of justice. In Ephesians 4:1, Paul beseeched the Ephesian church to "walk worthy of the vocation wherewith [they] were called." Law degrees from Harvard, Duke or other prestigious institutions are noteworthy educational accomplishments but doesn't define the quality of a person or make them honorable. The only true measure of excellence for a prosecutor or judge is whether they do justice and that is what makes them honorable. The judicial officials in the IRP6 case dishonor their vocation, dishonor justice and bring disrepute to their office and all other prosecutors, judges, court reporters and law enforcement personnel. They are veritable wolves in sheep's clothing who prey on the innocent and do violence to the law. I travelled with my sister to drop her off at a federal prison camp in Arizona. I can still taste the desperate sadness I felt that day. Every time I reflect back to the day I left my innocent sister at a dingy, cold prison while I returned to a nice hotel with a soft, comfortable bed still tears me apart and makes me cry. I remember lying in the hotel bed and feeling sick and guilty of my comfort, while my innocent sister had to sleep on a metal shelf with a thin mattress. This is what is behind the wall and through the door of the U.S. justice system! My younger brother Lamont, after spending six and a half years in Colorado State prisons, his conviction was overturned based on prosecutorial misconduct and lies by witnesses. My mother, Rose Banks, has suffered pain and heartache from wrongful convictions from three different children at the hands of American justice. Mysteriously disappearing court transcripts, judges threatening defendants and forcing them to testify, appellate judges allowing injustice to endure by not freeing innocent men and hold their subordinate judge accountable for her actions, judges and prosecutors hiding evidence and failing to uphold constitutional rights. These are the abominations that are behind the wall and through the door of the U.S. justice system! Illegally gaining access to citizens records by abuse of the Patriot Act, conspiracy, lies and deception by prosecutors and judges, pain, suffering and crying of the innocent wives and children of the IRP6 and cold-hearted prosecutors and judges who could care less that any of this is happening. This is what is behind the wall and through the door of the American justice system! Judges and prosecutors who don't have any respect for justice. This is the wicked abomination that is behind the wall and through the door of the American justice system! I know these facts present a very ugly and nasty U.S. justice system, but it's the truth. In the last couple years there have been numerous news reports of wrongful convictions resulting from lies and corrupt government officials. The problem with the media's coverage is that they never question the actions and conduct of prosecutors and/or judges who were responsible for the wrongful conviction. People are losing their freedom, many times from the malicious and irresponsible conduct of judicial officials and they are never held accountable or even answerable. There are no laws to hold them accountable so they really have no fear of breaking the law. Americans should not believe the hype about our justice system. All they see is the wall. The wall is deceptive because the holes are covered with a rhetorical tapestry that is woven with the finest linen of justice clichés and metaphors. I have taken you behind the wall through the door of the American justice system just as Edward Snowden took you behind the wall and through the door of the NSA. Court documents are not classified they are public records, at least the documents that are not being concealed by Judge Arguello, court reporter Darlene Martinez and the U.S. Attorney's Office in Colorado.
